When importing goods to Amazon Japan you’ll either need an entity or someone in Japan to act as your Importer of Record (IOR) or you’ll need to appoint an Attorney for Customs Procedures (ACP). An IOR or ACP helps you create commercial invoices, answer customs officials’ questions at the time of import, and keeps records of your importation in accordance with the customs law.
Finding someone who can act as your Import of Record is the most affordable and quickest option. Appointing an Attorney of Custom Procedures requires you to find a company that will facilitate the nomination and registration process with customs. It takes up to 8 weeks for a service provider to be registered as a ACP with customs in Japan.
Importer of Record (IOR)
An entity or person responsible for ensuring your imported goods comply with local laws and regulations as well as payment of applicable duties and taxes in Japan.
An Importer of Record could be a Japanese based business associate, friend or in-law who would be willing to represent you and act as your importer. You would use their name and contact information on your Commercial Invoice and Shipment Waybill. They would also be responsible for ensuring your imported goods comply with local laws and regulations. Obviously, you would ensure your goods would comply with Japanese laws and regulations before you even considered shipping to Japan.
It should be noted, that as the IOR is the official “importer” of the products, they can be legally liable for any problems arising from the products. Any claims arising from the use of the products, will go first to the importer. As such, the IOR must have Product Liability (PL) Insurance.
Attorney for the Customs Procedures (ACP)
An entity or person that can pay duties and taxes, which may be incurred at the time of import, on your behalf in Japan.
An ACP does not fully take over the responsibility of an importer in that it is only responsible for the payment of duties and taxes. You must ensure that your goods comply with the local laws and regulations as a part of your responsibility.
To Appoint an ACP you’ll need to submit various documents to customs officials in Japan including copies of Power of Attorney for the nomination of an APC, a copy of your company registration document , as well as some Japanese customs documents your APC service provider would procure. Once an ACP is granted, it is valid permanently unless the attorney is dismissed.
In some cases you would need to appoint more than one ACP as a new registration would be required if you were to ship to another port where jurisdiction of regional customs office differs. For example, Narita & Haneda airports and Tokyo seaport belong to Tokyo Regional Customs office, while Yokohama seaport is under the jurisdiction of Kanagawa Regional Customs office. If you were shipping to both ports you would require a ACP for each jurisdiction.
Appointing and registering a ACP can cost up to ￥35,000, around US$350
